Acceptance of Terms

By accessing and using the Platform ("Polaris"), provided by Blue Corona ("us", "we", "our"), our Clients and Partners (“you”, “your”) agree to comply with and be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, please do not use the Platform.

Description of Service

Polaris is a digital marketing analytics platform that offers insights into performance metrics and outcomes related to digital marketing services provided by us. The metrics, outcomes, insights, and features you have access to will depend upon the services Blue Corona provides for you and the features and information that Blue Corona has made available to you as part of your services. Polaris may also include other features, capabilities, and information may be available to you upon subscription to these as add-on services from Blue Corona.

Use of the Platform

You agree to use the Platform in context of the Services that Blue Corona provides for you and has enabled for your access in the platform. We grant you a non-exclusive right to use the Platform in accordance with these terms. The platform will solely be used to gain insights into the performance metrics and drive outcomes to enhance the digital marketing services, and in accordance with all applicable local, state, national, and international laws, and regulations. You will not use the Platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Platform.

You will also not share your logins, credentials, platform screenshots, or any information about and within the platform with other parties, including but not limited to other companies, affiliates, agencies, competitors, or partners without the express written consent of Blue Corona.

Any feedback you provide, ideas, proposals, and suggestions to improve the platform may be acted upon at our discretion and without restriction may be used without any notice or compensation to you.

Any third-party software, services, or other products you use in conjunction with Polaris and Blue Corona services are subject to their own terms and we are not responsible for third party products or platforms.

Fees and Payments

You agree to pay any/all fees for Services and any paid subscription components of the Polaris Platform that you contract to use with us. We reserve the right to suspend access to the Platform on non-payment of fees on the agreed upon schedule. We reserve the right to add or remove features, convert features into paid subscription access, and increase subscription rates within the ranges in our Services Agreement.

Intellectual Property

All features, functionality, and anonymous data aggregations and insights on the Platform are owned by Blue Corona and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Any marketing data that is generated on your behalf through the provision of services in the respective marketing platforms remains under your ownership.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Blue Corona’s written prior written consent. This includes transfer to any third party who performs other services on your behalf  or administers insights or reporting for you. Any attempt by you to assign or transfer these Terms, without such consent, will be null and void and may lead to a suspension or cancellation of your access. Blue Corona may freely assign or transfer these Terms to other parties as necessary or it deems fit for its business.

Data and Privacy

By using the Platform, you agree to the terms of our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy using the link on the Platform footer for more information on how we collect, use, and protect your data.

Termination

We reserve the right to terminate or suspend your account and access to the Platform, with or without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.

Disclaimers of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Errors and Inaccuracies

We reserve the right to terminate or suspend your account and access to the Platform, with or without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.

Availability of the Platform

We strive to provide the best possible service, but we do not guarantee that the Platform will be always available, uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Platform (in whole or in part) at any time, with or without notice to you. Any future release, update, or other addition to the Platform’s functionality will be subject to these Terms.
